Understanding the Clean Water Act §404
April 21, 2014, the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers jointly published a Proposed Rule intended to clarify definitions of waters of the United States for protection under the Clean Water Act (CWA) in the Federal Register. The public comment period has been extended through October 20, 2014. If the proposed rule is finalized, all tributaries, including ephemeral streams and many man-made drainage channels would become waters of the US. Definitions of Waters

While the goal of the proposed rule is to reduce the number of jurisdictional reviews, it has the potential to increase CWA permitting and mitigation requirements. This rule could also result in more extensive permitting requirements for projects currently being planned.
